Wei’s Pizza was previously at 2024 Salem Ave. in Dayton.
There were no issues when Wei’s Pizza operated on Salem Avenue, but when it moved to the Spinning Road address, the owner never obtained a new food service operation license, as required by law, said Greg Flannagan, spokesman for the Montgomery County Prosecutor’s Office.
The prosecutor’s office is asking Montgomery County Common Pleas Court for a temporary or permanent injunction against Wei’s Pizza.
Public health regulates and inspects restaurants, and Wei’s Pizza has been told multiple times it has to be licensed to stay open, Suffoletto said.
The civil complaint says a plans examiner and sanitarian gave Li an inspection report in November 2016 outlining what he needed to do to become licensed and properly open the business.
Reached by phone, Wei said he will take care of the issues. He said there were never any problems until his business moved.
